Terms of Service

These Terms of Service ("Terms") govern your use of the LuLu — Focus, Learn, Chill iOS application (the "App"), developed and maintained by Oleksandr Kostin ("Developer", "we", "us"). By downloading or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using LuLu, you confirm that you are at least 4 years old (or have parental permission), and that you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. License to Use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on any Apple device you own or control, solely for personal, non-commercial purposes, subject to these Terms and the Apple Standard EULA.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract the source code
• Use the App for any unlawful or unauthorized purpose
• Remove or alter any proprietary notices or labels

3. Subscriptions and In-App Purchases

Premium Subscription Plans

LuLu offers optional auto-renewable subscriptions that unlock premium features including additional background scenes, music tracks, and timer presets:

Billing and Renewal

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions in your App Store account settings.

Free Features

A meaningful set of core features is available without any purchase: the Desk scene, one music track per style, the Pomodoro timer, session reminders, and the focus calendar. A subscription is never required to use the App's core functionality.

Refunds

Refunds are handled exclusively by Apple. To request a refund, visit reportaproblem.apple.com.

4. Intellectual Property

All content in the App — including background videos, music tracks, sound effects, UI designs, graphics, and the LuLu name and logo — is owned by or licensed to Oleksandr Kostin and is protected by applicable intellectual property laws.

You may not reproduce, distribute, or create derivative works from any App content without prior written permission.

5. User Conduct

You agree to use the App only for lawful purposes. The App is a personal productivity tool; it does not support user-generated content, social features, or communication between users.

6. Screen Time / Full Concentration Feature

The Full Concentration feature uses Apple's Family Controls framework to block apps during focus sessions. You are solely responsible for which apps you choose to block. This feature is entirely optional and can be disabled at any time. We do not access or store any Screen Time data.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Oleksandr Kostin shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the App. Our total liability shall not exceed the amount you paid in the twelve months preceding the claim.

9. Governing Law

These Terms shall be governed by the laws of Ukraine. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kyiv, Ukraine, unless otherwise required by applicable law in your jurisdiction.

10. Apple's Role

These Terms are between you and Oleksandr Kostin, not with Apple Inc. Apple is not responsible for the App or its content and has no obligation to furnish maintenance or support services for the App.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will update the "Last updated" date at the top. Continued use of the App constitutes acceptance of the revised Terms.
